Fair Debt Collection Practices Act (FDCPA)

Know Your Debtor's Rights

The Fair Debt Collection Protection Act was added in 1978 as part of the Consumer Protection Act. It was written to protect consumers from abusive debt collection actions and to promote fair debt collection which includes protection against deceptive credit practices; and, to provide the means for debtors to dispute debt and obtain accurate information to validate debt.

As a member of the National Association of Consumer Advocates, The Tariq Law P.C. has been defending consumer's rights in the matter of debt collection and providing effective ways to improve their financial condition. A debt collection defense attorney from our office can assist you if you believe that your rights have been violated. Do not hesitate to consult with us. These matters only get more complex , stressful and more time-consuming to solve if you wait to take action.

The FDCPA protects you from many abusive actions, such as:

  • Only contacting you by phone between the hours of 8:00am and 9:00pm.

  • Communicating with you after written request has been made for validation of the debt (made within the 30 day validation period) and before they have mailed the proper documentation to you

  • Repeated and continuous calling with the intention of abusing, harassing or annoying the person at the number called

  • Abusive or profane language
