The Telephone Consumer Protection Act

The Telephone Consumer Protection Act or TCPA allows consumers to regain a sense of peace and stability in their homes. It strictly limits the use of automatic dialing systems and prerecorded or robotic voice messages, text messages and even faxes. It protects you from unwanted communications and gives you a way to force the callers to pay if they keep calling you without your express permission.

 

Protections Provided by the TCPA

 

  • Solicitors or collectors cannot call you after 9 p.m. or before 8 a.m.

  • Companies are required to have their own "do not call lists" to which you can request to be added to.

  • Companies are required to honor the national "do not call list".

  • Solicitors or collectors must identify themselves and provide a contact number

  • Solicitors or Debt Collectors are also not allowed to use automatic dialing systems or "robocalls" to make phone calls to a cell phone or to send text messages without your explicit consent. 

  • And many other protections

 

If a company violates these protections then you are entitled to file a lawsuit where you can be awarded up to $1,500.00 for each violation that you can prove even if you don't have any other financial damages. So if you were called fifty times in violation of this law then you could be entitled to up to $75,000.00 in statutory damages alone. Many consumers who are being harassed by debt collectors or telemarketers receive hundreds of these offensive calls and could be entitled to a court judgment in their favor.
